TO THE MAXIMUM EXTENT PERMITTED BY LAW, HMI MUSIC SERVICES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT PAID BY YOU TO US DURING THE TWELVE MONTHS PRECEDING THE CLAIM.

22. Waiver of Jury Trial
YOU AND HMI MUSIC SERVICES WAIVE ANY RIGHT TO A JURY TRIAL IN CONNECTION WITH ANY DISPUTE ARISING FROM THESE TERMS OR THE SERVICES.
23. Waiver of Class or Consolidated Actions
YOU AGREE THAT ALL CLAIMS SHALL BE BROUGHT IN AN INDIVIDUAL CAPACITY ONLY.
NO CLASS ACTIONS, CLASS ARBITRATIONS, PRIVATE ATTORNEY GENERAL ACTIONS, OR CONSOLIDATED PROCEEDINGS ARE PERMITTED.
24. Mass Filings Procedure
If twenty-five (25) or more similar claims are filed against HMI Music Services by the same or coordinated counsel, the parties agree to utilize a staged process of bellwether proceedings before additional claims may proceed.
25. Opt-out

All trademarks, service marks, logos, and trade names displayed on the Services are the property of HMI Music Services or their respective owners.

28. Copyrights; Restrictions on Use
All content available through the Services, including text, graphics, music, audio, software, databases, and designs, is protected by copyright and other intellectual property laws.

If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
Headings
Section headings are provided for convenience only and do not affect interpretation.
Survival
Provisions relating to intellectual property, indemnification, disclaimers, limitations of liability, dispute resolution, and any provisions that by their nature should survive termination shall survive termination of these Terms.
Our Relationship
Nothing in these Terms creates a partnership, joint venture, employment relationship, agency relationship, or fiduciary relationship between you and HMI Music Services.

32. Subscription Services

Unless otherwise stated, subscriptions automatically renew at the end of each billing period.

Cancellation will take effect at the end of the current billing cycle.
Subscription Pricing

Artist Representations
By creating an artist account, you represent and warrant that:

- Your content does not infringe any copyrights, trademarks, publicity rights, or other rights;
- You have obtained all licenses, permissions, and clearances required by law.
Artist Content License
You grant HMI Music Services a worldwide, non-exclusive, royalty-free license to host, stream, reproduce, distribute, display, promote, and market your content through the Services.
This license remains in effect until your content is removed from the Services, subject to reasonable archival, legal, and backup retention requirements.
Artist Payments
If revenue-sharing programs are offered, payment terms shall be governed by separate Artist Agreements and payout policies.
Artists are responsible for providing accurate tax and payment information.
35. Music Distribution and Marketplace Services
The Services may provide a marketplace for the sale, licensing, promotion, or distribution of music, merchandise, tickets, digital downloads, NFTs (where legally permitted), and related products.
Transactions Between Users
HMI Music Services may act solely as an intermediary between buyers and sellers.
We are not responsible for:
- Product quality;
- Delivery delays;
- Product descriptions;
- Seller conduct;
- Buyer conduct;
- Contract disputes between users.
Seller Responsibilities
Sellers are responsible for:
